Trade Buyers Terms & Conditions

1. Upon approval of this form the registered party (the Purchaser) is entitled to purchase goods from Plant Multi Nursery's site in Montrose at the advertised price (plus GST).
2. All purchases are to be paid in full at the point of sale or upon delivery.
3. Plant Multi Nursery will not be liable for any failure or delay in supply of goods for any reason beyond its control.
4. No claim for damaged goods are alleged shortages may be made after property in the goods has passed to the Purchaser, either on collection or delivery.
5. All deliveries by Plant Multi Nursery will incur a delivery fee. Current delivery fees are available from Plant Multi Nursery and are subject to review at any time.
6. The Purchaser must provide a safe and secure point for delivery and the Purchaser or a represntative of the Purchaser, must be on site to accept delivery of goods and assist with unloading, where required. If no one is on site, goods may not be delivered, or an additional handling charge may be charged to the Purchaser.
7. If any goods are compiled and/or held by Plant Multi Nursery on behalf of a Purchaser, storage/holding fees will be charged after the first 14 days. The fee charged will be 2% of invoice value for each 14 days. In the event that the order or any part of it is cancelled, a fee of up to 10% of the invoice value may be charged.
8. If payment is made by cheque and that cheque is dishonoured, the Purchaser agrees to pay the reasonable costs incurred by Plant Multi Nursery.
9. The Purchaser shall be liable for all expenses involved in enforcing payment on monies outstanding. These include but are not limited to, legal costs and interest at a rate of 4% above the amount specified in the Penalty Interest Rate Act.
10. The Purchaser must notify Plant Multi Nursery, in writing, of any changes to information provided on the Customer Registration form.
11. The onus is on the Purchaser to ensure the goods purchased are suitable for their intended use. We are not required by law to refund or exchange if you change your mind or have purchased in error.
